§ 100141.01. Level I-III Adult Trauma Centers and Trauma Receiving Hospitals.

(a)

Eligibility. A licensed general acute care hospital (GACH) may be designated by the local EMS agency (LEMSA) as a level I, II, or III trauma center if the GACH is verified by the American College of Surgeons (ACS) as meeting all requirements for ACS trauma verification as a level I, II, or III trauma center and satisfies the requirements under this section. ACS trauma verification requirements are set forth in the American College of Surgeons Resource for Optimal Care of the Injured Patient 2022 Standards, ISBN 978-1-7369212-9-6, released in March 2022, incorporated by reference.

(1)

ACS Verification Grace Period.

(A)

GACHs Seeking Designation. Licensed GACHs with a pending application for verification before the ACS may be provisionally designated as a Level I, II, or III trauma receiving hospital by the relevant LEMSA to receive trauma patients. The GACH must obtain ACS verification within twenty-four (24) months from the date of its application to the ACS.

(B)

Previously Designated GACHs without ACS Verification. If, prior to the effective date of these regulations, a licensed GACH was designated by a LEMSA as a level II or III trauma receiving hospital without meeting the eligibility requirements set forth in paragraph (1) of this section, the GACH must obtain appropriate ACS verification within twenty-four (24) months from the effective date of these regulations.

(C)

Discontinuation of Designation. Except as specified in paragraph (2) of this section, a GACH may not continue to be designated as a trauma receiving hospital if it fails to obtain ACS verification within the designated timeframe.

(2)

ACS Verification Exemption. A LEMSA may continue to designate a GACH that fails to obtain ACS verification as a level II, or III trauma receiving hospital if the following conditions are met:

(A)

The LEMSA, in collaboration with the GACH, addresses any areas of ACS non-compliance and develops a plan to achieve compliance.

(B)

The LEMSA can attest that the facility is capable of providing trauma care services consistent with ACS standards.

(C)

The LEMSA applies for and receives a trauma designation exemption for the GACH from the Emergency Medical Services Authority. The application shall include:

(i)

The ACS letter notification of failure of verification, to include the specific areas of non-compliance;

(ii)

The LEMSA plan to achieve compliance;

(iii)

The LEMSA attestation that, despite its failure to obtain ACS verification, the GACH is able to meet the standards set forth by the ACS in its provision of trauma care services.

(b)

Minimum Requirements.

(1)

Re-Triage of Trauma Patients. All trauma centers and trauma receiving hospitals are subject to the requirements of Section 100142.01 of this subchapter relating to the re-triage of trauma patients.

(2)

Data Collection, QI, and Evaluation. All trauma centers and trauma receiving hospitals designated under this section are subject to the requirements of Article 5 of this subchapter.

(3)

Additional Requirements. A LEMSA medical director may establish requirements for designation as a Level I-III trauma center or trauma receiving hospital, in addition to those required under this section.
